The ‘Milk’ ban: A sour decision for Oatly, and a wake-up call for plant-based food brands As of yesterday, Oatly and other plant-based brand owners can no longer use the word ‘milk’ (or other dairy related terms) in relation to plant-based products in the UK. Dairy industry groups see the decision as protecting consumers and traditional long-established dairy terms. UK Supreme Court hands down landmark Emotional Perception AI decision Today, the UK Supreme Court delivered a landmark judgment addressing the patentability of AI systems. In Emotional Perception AI Ltd v Comptroller General of Patents, Designs and Trade Marks, the Court has reshaped the legal framework governing the assessment of patent applications for Computer Implemented Inventions in the UK. It’s not whether an invention is immoral, but when that matters: Article 53(a) EPC and T 2510/18 Matt England explores the EPO's approach to Article 53(a) EPC, showing that an invention is excluded from patentability only if its commercial exploitation is immoral, not because of the circumstances of its derivation, as confirmed in T 2510/18. HLK has another success at the UPC HLK’s client, Establishment Labs, has prevailed in a preliminary objection at the Unified Patent Court. In this case, Establishment Labs is suing GC Aesthetics group and its Belgian distributor at the UPC for infringement of its European Patent No. 3 107 487 B1 relating to soft tissue body implants.
